CE3C WEBSITE PRIVACY POLICY

1.      Scope of Application and Responsibility

CE3C – Centre for Ecology, Evolution and Environmental Change, hereinafter referred to as CE3C, legally represented by FCiências. ID – Association for Research and Development in Science, with tax identification number 514 187 808, hereinafter referred to as FCiências.ID, is a private, non-profit association with public utility status, incorporated on 9 January 2017. 

The purpose of FCiências.ID is to carry out, support, enhance and promote its Members’ research, development and service provision activities, in particular through the implementation of R&D activities, project management and the promotion of initiatives that create conditions or facilitate the promotion or development of activities of high scientific, technological, engineering, innovation, dissemination, knowledge transfer and training intensity, which are beyond reproach from a legal, ethical and moral standpoint.

With the entry into force of the General Data Protection Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April (GDPR) on 25 May 2018, FCiências.ID’s commitment in this area is evident.
 
The use of the website www.ce3c.pt, as well as any interaction – commercial or otherwise – with FCiências.ID, and the processing of personal data provided by the data subject, are subject to the following conditions set out in the points below.

2. Use of the Website

The CE3C website is to be used exclusively for personal purposes. Its modification, reproduction, duplication, copying, distribution, sale, resale and other forms of exploitation, whether for commercial or non-commercial purposes, are expressly prohibited. The intellectual property rights to the website and its content belong to CE3C, unless otherwise stated.
 
CE3C grants only a limited, non-exclusive and non-transferable licence to view or print the website’s content for strictly personal and non-commercial use.
 
CE3C undertakes not to use this website for any illegal or prohibited purposes.

3. Data Collection

The organisation responsible for the collection, processing and storage of personal data is CE3C, with its registered office at the Faculty of Sciences, University of Lisbon, Building C2, 5th Floor, Room 2.5.46, Campo Grande, 1749-016 Lisbon, Portugal, in close coordination with and in compliance with the policies and procedures set out in the “INTERNAL REGULATIONS ON THE PROTECTION OF PERSONAL DATA” of FCiências.ID, approved on 19 May 2023 by the Executive Committee and available here. For data protection purposes, the CE3C may be contacted at the address given above, by registered letter with acknowledgement of receipt, or alternatively by email at geral@ce3c.pt.

Internally, the collection and management of personal data is the joint responsibility of the Secretariat and the Communications Office, whenever the initiative originates from them. These bodies are not responsible for any extraordinary collection of data undertaken on the own initiative of CE3C team members, and of which they claim to have no knowledge regarding its nature, objectives and/or procedures and legal framework.
 
The collection of your data arises from your specific interaction with CE3C and may serve one or more purposes, such as:

  • Requests for information and enrolment in training courses;
  • General enquiries;
  • Downloading of documentation;
  • Recruitment processes or unsolicited applications;
  • Outreach activities;
  • Sending of institutional information, advertising or marketing material, where consent has been given;
    Complaints and suggestions.

Depending on the nature of the interaction and only where necessary, CE3C may need to collect and process certain personal data, such as: name, email address, postal address/town, telephone number, national identity card or tax identification number, date of birth, gender, nationality, academic qualifications, employment status and/or bank/payment details, amongst other data provided on an ad hoc basis.
 
CE3C collects and processes only the data strictly necessary to fulfil its specific purpose, namely to:

  • Requests To provide an appropriate and targeted response to requests for information or quotations;
  • To communicate more effectively with you on relevant matters and only as frequently as necessary, based on the nature of your data and your preferences;
  • To fulfil institutional purposes, namely the collection of statistical data to improve the performance of the various services provided;
  • To invoice for services or products, such as training courses.

4. Data Retention Period

Personal data will be retained by CE3C for as long as is necessary for the proper fulfilment of the purpose for which it was collected and to meet other legal requirements.
 
Where personal data has been collected on the basis of consent, it will be retained until the data subject exercises their right to object to the continued processing of their data, unless another legal basis applies.
 
The retention periods for your data may vary significantly where public interest archiving purposes, or historical, scientific or statistical reasons are involved; CE3C undertakes to adopt appropriate retention and security measures. 

5. Data Sharing

CE3C may engage subcontractors through FCiências.ID for various purposes; these entities are obliged to implement the appropriate technical and organisational measures to protect the data subject’s data and to ensure that the data is used solely for the specified purposes.
 
Where applicable, CE3C may share the data subject’s information with:

  • The managing body, FCiências.ID; 
  • Managing bodies of the National Scientific System, namely the Foundation for Science and Technology;
  • Regulatory bodies, for the purposes of verifying compliance with the activities carried out by CE3C;
  • Other bodies falling within its sphere of activity, subject to due care being taken regarding the purposes for which the data is used.

CE3C reserves the right to amend or engage other sub-processors, without this altering the basis or purpose of the data processing.

 6. Rights of Data Subjects

Data subjects have the right, at any time, in accordance with and for the purposes of Articles 12 to 22 of the GDPR, to request:

  • Access to their personal data and to the information provided for in the GDPR;
  • Rectification or erasure, without undue delay, including the exercise of the right to restriction of processing and the ‘right to be forgotten’, where, in the absence of any other legal basis for such processing:
    • The personal data are no longer necessary for the purpose for which they were collected;
    • The data subject withdraws their consent, applicable only in cases where this is the legal basis for the collection and processing of data;
    • The data subject objects to the processing, beyond the maximum retention period;
       
  • Restriction of the processing of their data, if one of the following situations applies:
    • You have contested the accuracy of the personal data, for a period enabling the data controller to verify its accuracy;
    • The processing is unlawful and the data subject objects to the erasure of the personal data and requests, instead, that its use be restricted;
    • The data controller no longer needs the personal data for the purposes of processing, but the data subject requires the data for the purposes of establishing, exercising or defending a legal claim.
    • If you have objected to the processing, until it is established that the legitimate grounds of the data controller override those of the data subject;
    • Data portability, so that the data subject may transmit their data to other data controllers, if the processing is based on consent or is carried out by automated means;
    • The right to withdraw consent at any time, provided that this is the basis for the collection and processing of the data, without this affecting the lawfulness of the processing carried out on the basis of the consent previously given up to the date of its withdrawal.

Without prejudice to the data subject’s right to lodge a complaint with CE3C-FCiências.ID, the data subject may lodge a complaint with the National Data Protection Commission (Rua de São Bento, no. 148, 3rd floor, 1200-821 Lisbon; Telephone – +351 213 928 400; fax – +351 213 976 832; email – geral@cnpd.pt) or to any other supervisory authority that may be established for this purpose..

These rights must be exercised in writing by registered letter with acknowledgement of receipt sent to the address at the Faculty of Sciences, University of Lisbon, Building C2, 5th Floor, Room 2.5.46, Campo Grande, 1749-016 Lisbon, Portugal, or alternatively to the email address geral@ce3c.pt. 
 
For security and data protection reasons, when any of the above-mentioned rights are exercised, the data controller may require proof of the data subject’s identity.
 
CE3C centralises all matters relating to data protection via the email address geral@ce3c.pt. 

7. Cookies

n order to provide a better service to users, we use cookies, which are small text files placed on your hard drive by a website server. The CE3C website may require you to accept cookies in order to access all the available features.
 
Where consent is given, cookies will be used by CE3C to:

  • Collect users’ IP addresses.
  • Carry out statistical analyses to calculate the number of users and growth in user numbers;
  • Determine whether users have viewed a particular part of the website, thereby avoiding repetition of that content;
  • You can always limit or restrict the acceptance of cookies via your browser settings.

8. Limitation of Liability

The CE3C website may provide ‘links’ to external ‘websites’ for your convenience and information. By accessing these ‘links’, you will leave the CE3C website. CE3C does not control these websites or their privacy policies, which may differ from those of CE3C. CE3C does not endorse these websites. CE3C’s Privacy and Data Protection Policy does not cover any personal data that you may provide to websites outside CE3C.
 
CE3C does not sponsor any website that links to its website. CE3C is not responsible for the content of such websites. However, as the Internet is a global computer network, any information you send or transmit will necessarily be routed through third-party computers.
 
CE3C is not responsible for any breaches in the security of communications and accepts no liability for the misuse of your information by third parties. You, however, are responsible for the content of any information sent or transmitted to the CE3C website.
 
CE3C acknowledges that access to and use of its website may be subject to interruptions and that the information on the website may contain bugs, errors, technical faults, problems or other limitations, and that access may be impossible at certain times. CE3C is not liable for any damage caused by the use of its website. To the fullest extent permitted by law, CE3C disclaims all liability, whether direct or indirect, arising from the use of its website.

9. Changes to the Privacy Policy

CE3C may amend this Privacy and Data Protection Policy at any time to reflect feedback received and whenever justified.
 
We therefore recommend that you consult our privacy policy periodically to stay informed about how CE3C protects your Personal Data and to keep up to date with the information and rights to which you are entitled.

10. Applicable Law and Jurisdiction

This Privacy and Data Protection Policy is governed by Portuguese law.
 
The courts of the District of Lisbon shall have exclusive jurisdiction to settle any issues or disputes that may arise in connection with the application of these Terms and Conditions, and the parties hereby expressly waive any other jurisdiction.
